Where Opinions Are Used

01

German courts

German courts establish foreign law of their own motion and may rely on expert opinions to do so (§ 293 ZPO) — for contracts, corporate matters and enforcement governed by Ukrainian law.
02

Other European courts

Courts in the Netherlands and elsewhere in Europe deciding questions governed by Ukrainian law.
03

Arbitral tribunals

ICC, LCIA, SCC, DIS and investment treaty tribunals where Ukrainian law governs the contract, the corporate relationship or the investment.
04

Enforcement and recognition

Ukrainian law on the recognition and enforcement of judgments and arbitral awards, and on the status of Ukrainian court decisions abroad.
05

Preliminary assessment

Before a formal opinion: a short assessment for counsel of what Ukrainian law provides on the issue and how strong the position is.
06

Reviewing the other side’s expert

Analysis of an opposing expert’s report on Ukrainian law, for a reply opinion or for counsel’s own use.
03

Approach

An expert owes a duty to the court or tribunal, not to the party giving instructions. An opinion is only useful if it survives scrutiny.

Each opinion sets out the text of Ukrainian law in the version in force at the relevant date, the practice of the Supreme Court and, where the law is unsettled, the range of views — with the sources quoted in Ukrainian and translated into English.

Before accepting an instruction, I check for conflicts and confirm that the questions fall within my expertise. Scope, timetable and fee are agreed in writing before work starts.
